Terms of Service

1. Who you're agreeing with
BenchIQ is a product of Sadow LLC. These terms are a contract between you and Sadow LLC ("BenchIQ," "we," "us"). By creating an account or using BenchIQ, you accept these terms. If you're setting up a team, you accept them on behalf of that team's use of the service.
2. Who can use BenchIQ
You must be 18 or older to create an account. Players on your roster do not need accounts, and if they're under 18, they may not have one. By signing up you confirm you're at least 18.
3. What BenchIQ is (and isn't)
BenchIQ is a tool for scoring hockey games and viewing team and player statistics, offered in the United States and Canada (excluding Quebec). All game data is entered by people on your team. BenchIQ records and organizes it, but doesn't generate or verify it.
BenchIQ is early-access software. It's under active development, features will change, and you should expect occasional rough edges. We'll tell you about material changes to what you've paid for.
4. Accounts and roles
You're responsible for your account credentials and for everyone you invite to your team. Team roles (admin, coach, manager, scorekeeper, parent, and similar) control what invited people can do; the team admin decides who gets which role. Tell us at support@benchiq.app if you believe your account has been compromised.
5. Team data responsibility (read this one)
If you enter roster or player information, most of which describes minors, you represent that you have all necessary permissions to do so, including from each player's parent or guardian, and that you'll remove any player's information promptly if a parent asks you to (or ask us and we'll do it; see the Privacy Policy). You, not BenchIQ, are the source of the data you enter. If you add a date of birth or photo for a player, you represent that you are that player's parent or legal guardian.
6. Acceptable use
Don't: create or hold an account if you're under 18; scrape, harvest, or bulk-export other teams' data; resell or redistribute other teams' data, or data you accessed beyond your authorization; upload content you don't have rights to; harass anyone; probe, overload, or attempt to breach the service; or misrepresent your affiliation with a team. We may suspend accounts that do. Your team's own data is yours (see section 13), and sharing your team's results with family is the point, not a violation.
7. Fees, subscriptions, and refunds
Team subscription. $149 per year per team at our founders price (regular price $249 per year). It covers your team's full staff and scoring access, plus free live-game viewing and a basic box score for everyone your team invites. Each team needs its own subscription.
Founders price lock. Subscriptions purchased during our founders period keep their original rate for as long as they stay active; no future price change affects them. Founders pricing is available for a limited time and may end without notice. After the founders period, subscription prices may change for future terms with at least 30 days' email notice before your renewal.
Viewer premium. $50 per year per person. It unlocks the full stats experience: complete game breakdowns, full box scores, shot maps, trends, and season history, across every team you follow.
Trial. New teams get a 14-day free trial, no card required. If your trial ends without a purchase, we keep your team's data for 30 days so you can pick up where you left off, after which we may delete it.
Term and renewal. Subscriptions run 12 months from the purchase date and renew automatically. We'll email you a reminder before each renewal charge. Cancel anytime from your account; cancellation stops the next renewal and your access runs to the end of the paid term. We may change list prices for future terms with at least 30 days' notice before your renewal; your founders price stays locked as long as your team's subscription remains active. Prices don't include any applicable taxes.
Refunds. Not happy? Any charge, first purchase or renewal, either subscription, is fully refundable within 30 days, no questions asked. Email support@benchiq.app. A refund ends the refunded subscription's access when it's issued. After 30 days, fees are non-refundable.
8. Stats are user-entered; no accuracy warranty
Statistics on BenchIQ are entered by humans during live games and may contain errors. They're provided as-is for your team's own use. Don't rely on BenchIQ stats for recruiting, scouting, eligibility, or any decision with real consequences, and we're not responsible if someone does.
9. Warranty disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST. KEEP YOUR OWN RECORDS OF ANYTHING IRREPLACEABLE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SADOW LLC'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE IS LIMITED TO THE FEES YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST DATA, LOST PROFITS, OR SUBSTITUTE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. Some states don't allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
If someone brings a claim against Sadow LLC because of data your team entered or your breach of these terms, including a claim that your team lacked permission to enter a player's information, you agree to cover the costs and damages arising from that claim.
12. Termination and your data
You can close your account anytime by emailing support@benchiq.app. We can suspend or terminate accounts that violate these terms, with notice where practical. After termination, you'll have 30 days to request an export of your team's data at the same address, after which we delete it (backup copies expire on the cycle described in the Privacy Policy).
We may modify or discontinue features as the product evolves. If we discontinue the service entirely during a paid term, we'll refund the unused portion of your fees.
13. Who owns what
We own the BenchIQ software and brand. Your team owns the data it enters. You grant us a license to host, process, and display that data to run the service, and to use de-identified, aggregated data (never identifiable to a player or person) to improve BenchIQ and build new features. That license ends for identifiable data when your data is deleted.
14. Changes to these terms
We may update these terms as the product evolves. For material changes we'll email account holders and update the effective date; continued use after the effective date is acceptance. The current version is always at benchiq.app/legal/terms.
15. Governing law and disputes
These terms are governed by the laws of Pennsylvania. If the consumer-protection law where you live gives you rights these terms can't take away, those rights stand. Before any formal action, contact us; most issues resolve with an email. Either party may bring qualifying claims in small-claims court. Any other dispute will be resolved in the state or federal courts located in Bucks County, Pennsylvania, and both parties consent to that venue.
16. General
If any part of these terms turns out to be unenforceable, the rest still applies. These terms (plus the Privacy Policy) are the entire agreement between us about BenchIQ. You can't assign your rights under these terms without our consent; we may assign ours as part of a sale or reorganization of Sadow LLC, and this agreement binds the successor. Sections 5 and 8 through 13 survive termination. Neither party is liable for delays caused by events beyond its reasonable control.
